Why do I need a Will?
Many people, estimated to be about 1 in 2 in Australia, do not have a Will. By not having one, the NSW Succession Act will apply which may produce a result that you did not want. Every year, through accident or illness, families discover that if a loved one had made a Will then distress, delays and unintended consequences could have been avoided.
In many cases, preparing a Will can be achieved in only two meetings. At our first meeting, your circumstances are discussed and the relevant legal issues explained. For example, it is not well known that superannuation is not automatically distributed in accordance with the Will but by the trustees of the fund. In certain circumstances, it may be better to pay the superannuation death benefits into the estate and be distributed in accordance with the Will. Is your home owned as joint tenants or tenants in common and what difference does it make?
There are other important documents that you might wish to consider such as an Enduring Guardianship in which you nominate who can make decisions about your health and lifestyle should you no longer be able to make such decisions for yourself.
